Draft — Pending Attorney Review
This page is an internal draft skeleton and has not been reviewed or approved by a licensed attorney. It was prepared as a starting point only and is not yet final legal language.
Before this content is treated as the site's official policy — and in particular before Yellowhammer Trader scales real transaction volume or enters into any FFL / dealer partnership arrangements — it must be reviewed by a licensed attorney familiar with federal firearms law, ATF regulations, and Alabama firearms-transfer statutes.
Site staff: do not represent this page as legally vetted until that review is complete and this notice is removed by whoever performs the review.
Firearms Transaction Disclaimer
Please read this before buying, selling, or trading on Yellowhammer Trader.
This page explains what YHT is — and is not — when it comes to firearm transactions between members.
👤 No Identity or Eligibility Verification
Yellowhammer Trader (“YHT,” “the platform,” “we”) does not verify the identity, age, residency, or legal eligibility of any buyer or seller to purchase, sell, or possess a firearm, firearm part, ammunition, or related item.
- You are solely responsible for confirming that the other party to any transaction is legally eligible to buy, sell, or possess the item involved under applicable federal, state, and local law.
- A Verified, Supporter, Dealer, or VIP badge on a member's profile reflects a paid membership tier and, where noted, dealer/FFL document verification for that member's dealer status — it is not a representation by YHT that any specific transaction is lawful or that either party is eligible to complete it.
- YHT does not run background checks, does not check prohibited-person status, and does not confirm any user's claims about their own eligibility.
⚖️ Your Responsibility to Comply With the Law
Users are solely responsible for ensuring that any firearm transaction conducted through or arranged via Yellowhammer Trader complies with all applicable federal, state, and local law, including but not limited to:
- Laws governing who may buy, sell, receive, transport, or possess a firearm, firearm part, or ammunition;
- Any requirement that a transaction be conducted through, or a background check be run by, a Federal Firearms Licensee (FFL) — for example, many out-of-state private handgun sales must go through an FFL, and some states or transaction types require a background check even for private, in-state sales;
- Any Alabama-specific requirements applicable to the transaction, buyer, seller, or item.
The rules on when an FFL or background check is required depend on the item, the parties' home states, and current law — details that can and do change. We deliberately do not state specific legal thresholds here because we cannot guarantee they remain current. Before completing any transaction, confirm the current requirements yourself with the ATF, the Alabama Attorney General's office, a local FFL dealer, or an attorney. See the “Not Legal Advice” section below.
📋 YHT Is a Listings Platform — Not a Party to Your Transaction
Yellowhammer Trader provides classified listings and community forums so members can find and communicate with each other. That is the extent of our role.
- YHT is not a party to, and does not broker, guarantee, verify, or facilitate, the actual sale, payment, or transfer of any firearm or other item listed on the site.
- We do not take title to, hold in escrow, inspect, or handle any item listed for sale.
- We do not process payment for the sale of any firearm or item between members. How and where a transaction's payment and transfer happen is entirely between the buyer and seller (and, where required, their FFL).
Membership payments are not item transactions. Yellowhammer Trader uses Stripe to process payment for site membership tiers (Verified, Supporter, Dealer, VIP, and similar features) and for optional site services like ad placements. Those payments are for access to site features — they are completely separate from, and are not payment for, any firearm or item a member lists or buys. YHT does not process, collect, or route payment for the underlying sale of any firearm, and paying for a membership does not mean YHT is involved in, or a party to, any transaction between members.
🛡️ Meeting Safely — Consider a Safe Exchange Zone
When meeting another member in person to complete a transaction, take reasonable precautions:
- Meet in a public, well-lit place during daylight hours when possible, and consider bringing a friend.
- Look up your local police department's “safe exchange zone” policy. Many Alabama police and sheriff's departments designate a public, camera-monitored location (often in or near the department's lobby or parking lot) specifically for completing online marketplace transactions safely. Search for your local department's website or call their non-emergency line to ask if they offer one.
- Trust your judgment. If something about a listing, buyer, or seller feels off, it is always acceptable to cancel or postpone a meeting.
- Follow all applicable law regarding the transport and handling of firearms to and from any meeting location.
This Is Not Legal Advice
Nothing on this page constitutes legal advice, and it is not a substitute for advice from a licensed attorney. Laws governing firearm transfers change and vary by jurisdiction and by the specific facts of a transaction. If you have questions about whether a specific transaction is legal — including whether an FFL transfer or background check is required — consult a licensed attorney or your local FFL dealer before proceeding. See our FFL Directory to find a local dealer.
